Lawsuit Alleging Pollution At Cottonballs Dismissed

The Winneshiek County Court last week dismissed a lawsuit claiming that construction at a confinement chicken-raising site had caused underground environmental pollution to travel to a neighboring farm. On August 8, 2006 Marvin Meyer of Castalia sued Cottonballs, LLC alleging that had occurred at a site approximately two miles southwest of Frankville.
The court’s November 21, 2007 order dismissing this case stated, “Cottonballs is the only party to come forward with substantial and credible evidence, from both lay and expert witness and with scientific tests, as to whether a seep or sinkhole can be located on the real estate in question. This evidence is overwhelming when compared to that presented by the opposing side. Therefore, there remains no genuine issue of material fact to resolve at trial.” A three-day trial of this case was set to begin Wednesday, November 28, 2007 in Decorah.
Sholom Rubashkin, Vice President of Cottonballs LLC, stated, “We are very pleased with the court’s adjudication and that this case is over.”
